Terms of Service

1. Description

This SRT Internet Service (Service) is being provided to you (You), the end user, by SRT Communications, Inc (SRT). The provision of service to you by SRT is subject to the terms described herein and the limitation of liability provided in SRT's state tariff. There are no valid oral agreements between SRT and You. Your acceptance of Service constitutes an agreement of the terms and conditions contained herein and in SRT's state tariff. Your action is required to cancel Service. Cancellation may be processed by calling SRT at (701) 858-1200 or toll free 1-800-737-9130.

SRT provides You Service for the purpose of enabling access to the Internet and features available on the Internet. SRT provides only access to the Internet. SRT does not own or control all of the various communications facilities throughout the Internet. In accordance, SRT will NOT be responsible for access security nor warrant availability.  For Dial access, the available access number will be a local call from your area code and exchange.  Dial access is via telephone number(s) which SRT provides You. When using dial-up access to the Internet, You may incur a toll charge which is NOT the responsibility of SRT or the Service.

2. Credit

SRT DOES NOT GUARANTEE UNINTERRUPTED WORKING OF ITS LINES OR EQUIPMENT. In some cases as determined solely by SRT in its complete discretion, an adjustment for service outage will, upon application by a subscriber, be made in the amount of the charges for such service. Any adjustment shall apply only to the period the interruption continues beyond twenty-four (24) hours after notice of the interruption is received by SRT. No other liability shall in any case attach to SRT. Request for adjustment on bills must be made within 45 days from period of trouble, interruption or billing question.

3. Your Responsibilities

You agree...

  • To review this agreement
  • To provide SRT with accurate and truthful registration information and keep the information current while using the Service
  • Not to resell the Service
  • That You are responsible for the results of your use of the Service
  • Not to introduce viruses, worms or any other harmful code on to the Internet
  • To accurately address information sent using the Service
  • To obtain and provide all required permissions if You use the Service to receive, send, display, distribute or execute works protected by intellectual property laws including copyright and patent laws
  • To obtain, install and maintain suitable equipment and software necessary to access the Service
  • Not to use the Service for any criminal or illegal activities, or post information deemed legally actionable
  • Not to use the Service for spamming, flaming, nuking or hacking or to otherwise obtain unauthorized access to SRT's network or other networks
  • To hold SRT harmless from liability if you are offended, harmed or effected by information, products or services which you access through the Service
  • To hold SRT harmless from liability for any damages or costs associated with Your breach of or failure to perform Your responsibilities
  • To provide SRT with requested identification when requesting password reset or in connection with other security sensitive matters
  • To notify SRT if you suspect unauthorized use of the Service or your user identification. Until notified, You remain responsible for unauthorized use. Liability for use of a credit, debit or charge card remains subject to Your agreement with Your card issuer.
  • To pay charges for all Service usage You incur by any means
  • To comply with all applicable laws and regulations including those specific to data privacy and international communications

4. Disclaimer and Limitation of Liability

Third party providers own, maintain, and support their services and content. The availability of such services and content are the responsibility of the individual provider. Certain services and content may contain images or language that are considered offensive or of an adult nature to certain users. This material is the sole responsibility of the individual provider. SRT does not endorse such material and disclaims any and all liability from its content.

If a subscriber is dissatisfied with the Service or features of the Service, UPON NOTICE FROM THE SUBSCRIBER, SRT will terminate the agreement and Service and refund the unused portion of the unused fees for the current month and future months, if paid, less balances otherwise due to SRT.

This Service and products related to this Service are provided AS IS No warranty is given that the program, service or products are error-free.

SRT offers no guarantees or warranties on the performance of its network and Internet connections. Actual connection speeds of Dial access and High-speed access may vary depending on service location, computer performance and configuration, or Internet congestion. Upload and download speeds of High-speed service packages are quoted/printed as maximum expectations consequentially, technical limitations may limit performance. SRT may terminate Internet service provided to any subscriber found in violation of this agreement and which constitutes misuse of SRT's network or connected networks. SRT reserves the right to deny service to potential and current subscribers. SRT will be held harmless from any liability arising from special, indirect or consequential damages including but, not limited to lost profits, loss of opportunity, or other loss which may result from the use of, misuse of or lack of availability of SRT or their facilities.

Acceptable Use Policy

SRT Internet subscribers that violate this Acceptable Use Policy (AUP) are suspended and notified of the violation. The subscriber is provided with means to reactivate service upon their full rectification of the situation. If the situation arises again after reactivating service, the subscriber's Internet service is disconnected permanently.

Actions which SRT considers misuse and violate SRT's Acceptable Use Policy include:

  • Attempting to obtain unauthorized access to any network or account. This includes accessing data not intended for the customer, logging into a server or account without being expressly authorized to access or probing the security of other networks.
  • Attempts to interfere with the service of others including users, hosts and networks. This includes denial of service attacks, flooding of networks, deliberate attempts to overload a service and attempts to "crash" any host.
  • Harassment through language, message frequency or message size
  • Sending messages to any person not wishing to receive it. Requests by the recipient to stop receiving such messages must be respected.
  • Sending unsolicited messages which, in the judgment of SRT, is disruptive or generates a significant number of user complaints. This includes bulk-mailing of commercial advertising and/or informational announcements.
  • Malicious mail, such as mail bombing or flooding a user or host with very large and/or frequent pieces of mail
  • Forging message header information
  • Collecting message replies from messages sent through another Service Provider where those messages violate these terms or the terms of that other provider
  • Introducing harmful code and/or viruses on the Internet
  • Cross posting, UseNet spam, otherwise posting the same messages to large numbers of unrelated newsgroups
  • Posting of message(s) of which the subject matter is unrelated to the content of the newsgroup posted to or generates a significant number of user complaints
  • Posting of binary or executable files to newsgroups not created for that purpose
  • Distribution and/or storage of material of any type or in any format on or over SRT systems or servers in any manner that constitutes an infringement of third party intellectual property rights, including rights granted under the US copyright laws.  Complaints should be directed to dmca@srt.com.
  • Posting any content advocating ridicule or public scorn towards SRT, its employees, board members or associates
  • Posting of scandalous, threatening, harassing or private information without consent of the person, persons or organizations involved
  • Posting content of nature that is obscene, lewd, lascivious, violent, harassing or objectionable, or content which violates 47, USC § 230
  • Hosting bulletin boards or chat sites using personal web space provided with the Service

Network Management

  1. Subscriber Management
    • Currently, SRT does not participate in subscriber management practices that would limit or manage an individual customer’s throughput.
  2. Application-Specific Management
    • An SMTP Port 25 block is in use to reduce spam and viruses that originate from compromised customer computers. SRT Internet customers that operate their own email server must register their email server with SRT to have port 25 opened. 
    • No other protocols or protocol ports are blocked nor rate-controlled
    • Mass mailing to SRT customers is limited to 25 recipients per message. In order to conduct a mass mailing, senders should divide their task into groups of 25 recipients or less or invest in email marketing client software and or services.
    • Email messages are limited to 12 MB or less for the convenience of the recipient.
  3. Traffic Priority
    • Although SRT will capitalize on opportunites to better customer experience and lessen operational cost, SRT does not favor any traffic over other traffic, which would include the use of traffic shaping, prioritization, or resource reservation, to benefit anyone other than customers.
  4. Congestion Management
    • SRT doest not practice any form of congestion management in terms of limiting customer throughput based on any form of usage limit.
  5. Device Attachment
    • SRT must use a variety of technologies to best serve a diverse customer base.  Each technology requires unique subscriber end equipment.  To simplify installation and provisioning processes for both the customer and SRT, SRT provides an approved selection of subscriber end equipment dependant on the service requested. 
  6. Security
    • SRT implements an intrusion prevention system (IPS) system for the purpose of identifying and blocking malicious activity.  This network based system protects customers and the SRT network by monitoring the network for suspicious traffic.


  1. Service Description
    • SRT offers wire line Internet services and numerous service plans with specific line-speed options.
    • Line-speed is the speed of the Internet service delivered specifically to the SRT provided subscriber-end equipment, which may be a DSL modem or fiber network interface. Line-speed and service availability are dependent on network infrastructure and the subscriber’s proximity to an SRT wire center.
    • Line-speeds do not define home or office network speeds.
    • Home or office network speed is the speed at which subscriber provided devices connect with each other, to routers, switches and wireless access points or to SRT provided subscriber-end equipment.
    • Free Basic Wi-Fi is a complimentary service utilizing SRT provided subscriber-end equipment with a single integrated wireless access point. A single wireless access point may not provide coverage for an entire subscriber premise. Coverage will also be limited by visible obstructions and wireless interference. Whole home or office coverage may require additional wireless access points.

  • SRT does not prevent or block users from sending or receiving any lawful content; running lawful applications and using lawful service.  Further, SRT does not discriminate against any lawful content or application.
